Employment Tribunal Fees abolished – what you need to know

By Dave Stallon, FSB's commercial and operations director.

Yesterday, the Supreme Court ruled that tribunal fees are unlawful after a case was taken before judges by Unison, which argued the system stopped workers from accessing justice.

Employment Tribunal fees were put in place to curb the number of unfounded claims and we believe a fair and proportionate system of fees should be put in place to prevent vexatious claims.

The ruling means employers could now be open to more claims, potentially costing thousands of pounds in legal costs.

The good news is that FSB’s Legal Protection Scheme already offers our members and their businesses automatic access to legal costs insurance including Employment Tribunal representation. It has a 24 hour legal advice helpline as well as an online legal information hub providing a comprehensive range of support materials.

Our legal protection and advice is one of the most valuable benefits we offer, according to our members. To have access to legal and tax specialists in support of your business can cost tens of thousands of pounds.

Having advice, support and insurance protection for a wide range of legal and tax scenarios is essential to the success of any business.

In addition to Employment Tribunal Representation, our legal costs insurance also includes: criminal prosecution defence; tax and VAT; property disputes cover; jury service payment; personal injury pursuit cover; and statutory licence protection.

As the UK’s biggest business support group, FSB’s focus is both on successfully engaging with Government and opposition parties to make important policy decisions, whilst offering effective tools, advice and benefits that have a positive impact on the day-to-day lives of small business owners and the self-employed.

If you’re not already a member of FSB Business Essentials you’re missing out on this and many other inclusive benefits from tax investigation protection and business banking to workplace pensions schemes. Find out how to join FSB.
